Overview

The Hardin County Municipal Court provides eligible Defendants with a Traffic Safety program (Safe Driver Online) that is helpful in providing driving tips on a variety of topics related to the safe operation of a motor vehicle. The Traffic Safety Program (TSP) allows approved Defendants to have their case dismissed upon successful completion of the Safe Driver Online program, payment of the program fee and payment of the $200.00 Court fee for their traffic violation. The course is 2 hours long and consists of several modules. It may be done all at one time or over a period of time, but must be completed within 45 days of entering the program. The cost of the program is $24.95.

The minimum criteria for participating in the Traffic Safety Program are:

• A single two-point minor misdemeanor traffic violation with no accompanying criminal charges;
• The traffic case does not involve an accident or property damage;
• The Defendant has not participated in any Traffic Safety program within the last 4 years;
• Defendant has a valid license at the time of the violation;
• DOES NOT HAVE A CURRENT COMMERCIAL DRIVER’S LICENSE (CDL) AT TIME OF VIOLATION.

Steps of the Traffic Safety Program

Up to 3 days after the arraignment date on the citation you must do the following:

• Be referred to the Traffic Safety program by Law Enforcement, the Prosecutor or the Court;
• Defendant is to be advised of terms and conditions of the program;
• Defendant enters a conditional plea of guilty and signs the form agreeing to complete the Safe Driver Online program within 45 days;
• The Court stays Defendants sentencing of fines and costs;
• Defendant pays the $200.00 TSP fee promptly once forms are submitted and approved.

NOTE: YOU CANNOT TAKE THE ONLINE CLASS UNTIL THE COURT HAS RECEIVED AND APPROVED YOUR SIGNED ACKNOWLEDGEMENT AND AGREEMENT AND CONDITIONAL GUILTY PLEA AND TIME WAIVER FORMS ALONG WITH YOUR PAYMENT OF $200.00.

The Court will accept filing of the Acknowledgement and Agreement and Conditional Guilty plea and Time waiver forms by fax at (419) 674-4096 or at the Clerk’s window.

Once your forms are approved, you may pay your $200.00 TSP fee by cash, money order or cashier’s check. THIS IS NOT PAYABLE ONLINE.

Failing to Complete the Program/Consequences

• Defendant fails to pay the $200.00 Traffic Safety program fee;
• Defendant fails to complete the TSP class within 45 days after admission into the program;
• Conviction will be forwarded to the Bureau of Motor Vehicles and points will be added to the Defendant’s driving record

NOTE: NO EXTENSIONS WILL BE GRANTED AND NO REFUNDS WILL BE GIVEN FOR NOT COMPLETING THE TSP CLASS. COURT FEE OF $200.00 IS NON-REFUNDABLE.
